What Is Bail?

Under Texas Code of Criminal Procedure Article 17.01, bail is defined as security given by the accused that guarantees they will appear before the court to answer the criminal accusation against them.

Bail allows the defendant to remain out of custody while their criminal case proceeds through the legal system. The court sets a bail amount to ensure the person returns for future court appearances.

In many cases, the full bail amount can be very high, which is why many families choose to work with a licensed bail bond company.

What Is a Bail Bond?

A bail bond is a written agreement guaranteeing that the defendant will appear in court as required.

Under Texas Code of Criminal Procedure Article 17.02, a bail bond is an undertaking entered into by the defendant and sureties that guarantees the defendant’s appearance before the court.

When a bail bond company posts bail, they assume financial responsibility for the full bond amount if the defendant fails to appear in court.

This allows families to secure a release by paying only a small percentage of the total bail amount, typically around 10%.

Step-by-Step Bail Bond Process

Understanding the typical bail bond process can help families know what to expect after an arrest.

Step 1 – Arrest and Jail Booking

After an arrest, the individual is transported to jail where they are processed through the booking system.

This typically includes:

• fingerprinting
• photographs
• entering the arrest into the jail database
• documenting the charges

The person will remain in custody until bail is set or until they appear before a judge.

Step 2 – Magistration Hearing

Under Texas Code of Criminal Procedure Article 15.17, the arrested individual must be brought before a magistrate without unnecessary delay, generally within 48 hours.

During the magistration hearing, the judge will:

• inform the defendant of the charges
• explain their legal rights
• determine whether bail will be granted

If bail is granted, the judge sets the bail amount.

Step 3 – Bail Amount Is Set

Judges determine bail amounts based on several factors including:

• seriousness of the offense
• criminal history
• public safety concerns
• likelihood the defendant will appear in court
• the defendant’s financial ability to make bail

Each case is evaluated individually based on these factors.

Step 4 – Contact a Bail Bond Company

Once bail has been set, the next step is contacting a licensed bail bond company.

If the full bail amount cannot be paid directly to the court, a bail bond company can post bail on behalf of the defendant for a percentage of the bond amount.

A family member or friend typically acts as the cosigner (indemnitor) and signs the bail bond agreement.

Step 5 – Bail Bond Paperwork

Once the bail bond company is contacted, the required paperwork must be completed.

This usually includes:

• defendant information
• cosigner information
• bond agreement documentation

In many cases, the paperwork process can be completed in 15 to 30 minutes once the necessary information is available.

Some bail bond companies also allow families to begin the process online to speed up the release timeline.

Step 6 – Bond Is Posted at the Jail

After the paperwork and payment are completed, the bail bond agent submits the bond to the jail where the defendant is being held.

Once the jail accepts the bond, the inmate enters the jail’s internal release process.

Step 7 – Jail Release Processing

After the bond has been posted, the jail must complete several internal procedures before releasing the inmate.

Typical release estimates in Harris County are: approximately 8 to 12 hours

Release times may vary depending on:

• jail staffing levels
• number of inmates being processed
• time of day
• internal jail procedures

What Happens After Someone Is Released on Bail?

Once someone is released on a bail bond, they must follow all conditions set by the court and appear at all scheduled court hearings.

Common requirements include:

• attending all court appearances
• avoiding additional criminal activity
• complying with any pre-trial supervision conditions

Failure to appear in court can result in:

• a bench warrant for arrest
• bond forfeiture
• additional criminal charges
